An ATE Insurance policy, often known as legal expenses insurance, covers the policyholder against being liable for costs when they have decided to bring or defend a legal action.
In most cases the ATE policy would be to cover some or all of the other side's costs and the claimant’s own solicitor’s disbursements, dependant upon the policy taken out.
Normally, ATE cover is arranged before proceedings have been issued, although cover can be taken out at a later stage in the claim. The policy premium is usually staged so that the premium will be lower if the case settles early.
Payment of the premium is usually deferred until the outcome of the case, with the premium only payable in the event of the case being successful. If the case is unsuccessful, no premium is due.
