Top Tip - Fixed costs

In December we received news of District Judge Jackson’s decision that an RTA claim that settled pre-issue for £350,000 should be subject to fixed costs.  

This was because the claim had started in the portal (even though later removed because of its high value) and is the the consequence of the removal of the upper limit of £25,000 in CPR 45 III A. If the claim starts in the portal and drops out, but is not then allocated to the multitrack, the fixed costs provisions will apply regardless of the value of the claim.
